The General Terms and Conditions of Contracting serve to regulate the distance selling relationship between LIGHT EYES SL and the users or customers, in accordance with the legal provisions, in particular, Act 7/1998 of 13 April on General Terms and Conditions of Contracting, Act 3/2014 of 27 March, approving the revised text of the General Act for the Defence of Consumers and Users, Act 15/1999 of 13 December, concerning Protection of Personal data, Act 7/1996 of 15 January concerning Retail Trade, and Act 34/2002 of 11 July, concerning Information Society Services and Electronic Commerce.

These amendments may be made, through its website, in any other legal way and compliance therewith will be mandatory throughout the time that such amendments are published on the web, and until they are validly modified by subsequent amendments. Moreover, LIGHT EYES SL reserves the right to apply, in determined cases, Specific Terms and Conditions of Contracting, with preference over these General Terms and Conditions, as it deems appropriate, announcing them in the appropriate time and way.

The duration of the contract will be tied to the ending of the service contracted or to the delivery of the product, subject to the costumers right to reject.

Prices

We indicate the selling price of all the services and products in Euros and we also include the Value-Added Tax (IVA).

Expenses and provision of services

Delivery and transport costs

LIGHT EYES SL specifies the shipping destinations for each product. Shipping costs will be applied depending on the area of the ​​shipment, the size, the weight, the product dimensions and the amount of the order. Forms of payment and execution of the service

The customer can pay the amount of their order in any of the following ways. During the purchase process the customer must choose the form of payment:

Credit Card, VISA/MASTERCARD

All operations involving the transmission of personal or bank details are made through a secure environment, based on the SSL (Secure Sockets Layer), which is the standard security technology. Any information that is supplied to us is transmitted encrypted through the network.

If the purchase amount had been charged fraudulently or improperly using a credit card number, the card holder may demand an immediate cancellation of the charge. In such a case, the corresponding debit and recredit entries in the accounts of the provider and the holder will be made as soon as possible.

However, if the purchase had actually been made by the card holder and the refund demand was not a consequence of having exercised the right of cancellation or withdrawal and, therefore, the cancellation of the corresponding charge had been improperly demanded, they will be obliged to compensate LIGHT EYES SL for damages caused as a result of such cancellation.

Bank Transfer

When selecting the bank transfer as your method of payment, you will receive the confirmation by means of an email with the bank details of LIGHT EYES SL.

When making the transfer, it is very important to indicate in the subject the order number, as well as your name and surname, and you should make the transfer within the first 3 days after the date of confirmation of the order to validate this.

Please remember that the payment must be made in EUROS and that all possible exchange and banking commissions will be charged to you.

In the event of bank transfers made from outside of Spain, it is very important that when you make the transfer, you always request the bank to make you responsible for the bank commissions and expenses corresponding to the entity. If not, LIGHT EYES SL could paralyze the service contracted since it would not receive the full amount thereof.

Any possible exchange and bank fees are borne by the customer.

Right of withdrawal, refund and claims

The client will have a period of fourteen calendar days to desist, from the day of conclusion of the contract, without any penalty and without indication of the reasons.

The exercise of the right of withdrawal must be made by notification on the telephone number 932491405; via email secretaria@light-eyes.com; sending your letter to our postal address C/ SANT JOAN DE LA SALLE 42 08022 BARCELONA; or through the withdrawal form.

As set out in Article 103 of the Act 3/2014 of 27 March, which approves the changes of the revised text of the General Act for the Protection of Consumers and Users, supplies of services or goods made according to consumer’s specifications or clearly personalised, or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, are exempt from withdrawal.

If the customer requests the provision of the service to start during the withdrawal period, they will be bound by the contract to pay the amount proportional to the part of the service provided at the moment the withdrawal was notified, in relation to the subject-matter of the contract.

The return of the product by the right of withdrawal

The customer must return or deliver the product directly to LIGHT EYES SL, at the address C/ SANT JOAN DE LA SALLE, 42, 08022 BARCELONA, without any undue delay, within a maximum period of fourteen calendar days from the date in which the right of withdrawal of the contract is formalized. That time limit is considered fulfilled if the customer returns the product before it expires.

The customer will pay the costs of returning the product.

In any case, the returned products must be in a perfect condition, unused, and in its original packaging. We therefore kindly ask you to ensure that the package is properly protected and sealed in order to avoid problems during transportation. Once the returned articles have been received, we will check their condition. Once we have checked that the article(s), as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will refund the corresponding money.

Return of a defective product.

In the event that the product is not in a good condition and the customer is not responsible for the causes attributable to this, the customer will be entitled to return the product, informing LIGHT EYES SL of the reason for returning by any of the means provided in these terms and conditions of contracting, and at no cost to the customer. This refund, as a result of defect or poor condition of the product, will not be considered a right of withdrawal.

LIGHT EYES SL agrees to bear the cost of the return and replace the product with a new one according to the conditions agreed when the purchase was made.

Reimbursement of payment

The reimbursement of the amounts received from the customer will be made using the same payment method used by the customer, provided that an alternative method has not been requested.

LIGHT EYES SL will pay the amounts satisfied by the client within 14 calendar days from the date of receipt of the right of withdrawal.

In case of unjustified delay by LIGHT EYES SL, regarding the refund of the amounts satisfied, the customer may claim double the sums paid, without prejudice to the right to be compensated for damages suffered, which exceed that amount.

Jurisdiction

LIGHT EYES SL reserves the right to file the civil or criminal actions it deems appropriate for the misuse of its website and content, or for a breach of these conditions.

The relationship between the user and the service provider shall be regulated by existing Spanish laws and the courts of Spain. In the event of a dispute related with the application of these terms, the parties may submit their claims to the jurisdiction of the Tribunals or to an ordinary court of law in accordance with applicable legislation.
